These General Terms and Conditions of Service apply to the purchase of products/services that TWIST DE NARANJA S.L. markets through the website hosted at the URL https://shop.salmonguru.es to any user.

The purchase of the products and/or services offered through the Website entails the acceptance of the terms and conditions set forth in these General Terms and Conditions of Service so, before proceeding to their acceptance, please read their content carefully. If you do not accept these General Terms and Conditions, the purchase of the products/services will not be carried out and, consequently, will not entail the assumption of any type of obligation or liability on the part of TWIST DE NARANJA S.L.

By placing a purchase order through the Website, the Customer declares to be over 16 years of age and to have the legal capacity to purchase the products on the Website.

In order to place a purchase order, the Customer must follow each of the steps of the purchase procedure provided on the Website.

TWIST DE NARANJA S.L. reserves the right to modify the content and/or scope of the General Terms of Service at any time, without prior notice or communication, so please read its content carefully as it is the Customer's responsibility to review the General Terms of Service before purchasing any product from the Website.

 

CUSTOMER REGISTRATION

To start the purchase procedure of the products of the Web Site, the Customer must register in the section of the Web Site “Register”. In subsequent purchase processes, in the event that the Customer has registered it will only be necessary to provide your email address and password in the “Login” section. PRICE AND METHOD OF PAYMENT

The price of the products will be the one that appears in the currency indicated next to each product on the Website.

The sales prices indicated on our website are shown as follows:

- If the Customer resides in the European Union, the prices include the taxes applicable at any time (VAT) and product/service.

- If the Customer resides outside the European Union, prices do not include VAT. However, the Customer will be responsible for any local taxes and/or any local import and/or customs duties when the shipment arrives at its destination, if applicable.

 

TWIST DE NARANJA S.L. reserves the right to make, at any time and without prior notice, the changes it deems appropriate, and may frequently update the products or prices. The price applicable to the purchase request made by the Customer will be the one stated at the time of accepting the General Conditions of Service.

The Client will be able to make the payment of the products by means of BANK TRANSFER, whose data will be facilitated to him when confirming the order.

Once the purchase process is completed, an electronic confirmation will be generated, which the Customer will be able to print, being filed in the “My Account” section.

TWIST DE NARANJA S.L. does not have access to or store sensitive data related to the means of payment used by the Customer. Only the corresponding payment processing entity has access to this data in order to manage payments and collections.

TWIST DE NARANJA S.L. has implemented a program to detect possible fraudulent transactions and reserves the right to request additional information, confirmations and/or documents from the Customer, even after having made one or more purchases through the Website, by phone call or e-mail, in order to confirm that the Customer has indeed made and authorized such purchase and/or that the delivery or return of the same has been made correctly and thus definitively authorizes the respective transaction.

TWIST DE NARANJA S.L. may make various telephone verifications of the Customer's identity, or request: (a) a written confirmation and authorization signed by the Customer responsible for the respective purchase; and (b) a copy of the Customer's valid official identification with photograph to confirm his or her identity. TWIST DE NARANJA S.L. undertakes to store such information and documents with high security measures, in accordance with current regulations.

In case the Customer does not respond favorably or does not provide TWIST DE NARANJA S.L. with the requested documentation and information within 48 hours from the call or email sent by TWIST DE NARANJA S.L., the transaction detailed in such communication and the respective order may be cancelled, without further notice or liability of TWIST DE NARANJA S.L. proceeding to refund the Customer the amount paid with respect to such purchase.

Such verification procedure is carried out for the security of the Customer and, therefore, by accepting these General Terms and Conditions of Service, the Customer agrees to submit to the aforementioned procedure for the detection of possible fraudulent transactions and authorizes TWIST DE NARANJA S.L. so that, once the Customer provides the aforementioned additional information and documents, these may be used for future purchases by the same Customer.

 

DELIVERY OF SERVICES

Once TWIST DE NARANJA S.L. has verified that the purchase process has been carried out correctly, it will proceed to deliver the products to the address indicated by the Customer in the purchase procedure, during normal business hours and within the deadlines set forth in the Website.

In the event that, upon opening the packages with the products, the Customer sees that the services are not as desired or cannot be performed for any justified reason, he/she must notify TWIST DE NARANJA S.L. in writing within five (5) calendar days of the purchase, so that TWIST DE NARANJA S.L. may proceed in a timely manner.

All product purchase orders are subject to product availability. In case of unavailability of the contracted product, TWIST DE NARANJA S.L. will inform the Customer and may offer a service of similar characteristics of equal or higher quality, although the Customer, alternatively, may cancel the purchase order and recover the amount paid within a maximum period of thirty (30) days.

RIGHT OF WITHDRAWAL

You have the right to withdraw from this contract within 14 calendar days without giving any reason.

To exercise your right of withdrawal, you must notify us of your name, your full address and, if available, your telephone number and e-mail address, your decision to withdraw from the contract by means of an unequivocal statement by e-mail. You may use the model withdrawal form.

In the event of withdrawal by you, we will refund all payments received from you, including the costs of delivery (with the exception of the additional costs resulting from your choice of a mode of delivery other than the least expensive mode of standard delivery offered by us) without undue delay and, in any event, no later than 14 calendar days from the date on which we are informed of your decision to withdraw from this contract. We will proceed to effect such reimbursement using the same means of payment used by you for the initial transaction, unless you have expressly provided otherwise; in any event, you will not incur any costs as a result of the reimbursement, We may withhold the reimbursement until we have received the goods, or until you have provided proof of the return of the goods, whichever condition is met first.

Without undue delay and in any event not later than 14 calendar days from the date on which you notify us of your decision to withdraw from the contract, you must deliver or send the goods to the address indicated below. The deadline shall be deemed to have been met if you return the goods before the expiry of this period. You shall bear the direct cost of returning the goods and shall only be liable for any diminished value of the goods resulting from handling other than what is necessary to establish the characteristics of the goods.

COMPLAINTS AND CLAIMS

The Customer must contact TWIST DE NARANJA S.L., through the means indicated at the beginning of the General Terms of Service, to express his/her complaints and claims, and TWIST DE NARANJA S.L. commits itself to attend them as soon as possible and, in any case, within one month after they are presented.

APPLICABLE LAW AND JURISDICTION

The General Terms of Service shall be governed by and construed in accordance with Spanish law.

In the event of any conflict or discrepancy arising in the interpretation and/or application of the General Conditions, the competent Courts shall be those provided for in the applicable regulations regarding the competent jurisdiction of consumers and users. The parties expressly submit, for any questions or differences that may arise due to the interpretation, fulfillment and execution of this contract, to the jurisdiction and competence of the Courts and Tribunals corresponding to the domicile of the purchaser or to those of the place of fulfillment of the contractual obligation.
